BRAZIL DIDN'T JUST REWRITE THE AD RULES. IT BANNED THE PRODUCT.

Brazil's Provisional Measure No. 1,394, dated 25 September 2026, prohibits the operation, offering, intermediation and advertising of fixed-odds betting nationwide. The measure covers sports betting and online games, both physical and virtual. The Ministry of Finance published a detailed transition timetable on 2 October, subsequently updated on 7 October.

OFFSHORE OPERATORS ARE NOT EXEMPT.

The prohibition expressly extends to businesses headquartered abroad when they offer the covered betting products to people in Brazil. It also reaches state and district authorisations for fixed-odds betting. Other lottery categories permitted by Brazilian law are not automatically covered by the measure. The distinction matters: this is not a blanket ban on every lottery product.

THE SHUTDOWN CAME WITH A CLOCK.

According to the Ministry of Finance, new deposits were prohibited from 25 September. Players could request voluntary withdrawals until 5 October. Betting websites and apps were required to become unavailable from 6 October. Remaining balances were scheduled for return through financial institutions from 9 to 14 October, with Caixa Econômica Federal assisting in certain operational cases from 15 October. These are the government's stated transition dates, not BETDILLA's independent verification of each operator's compliance.

CPA, REVSHARE AND MEDIA BUYING FACE A REAL COMPLIANCE PROBLEM.

For affiliate managers and paid media teams, the immediate question is whether a campaign promoting the covered product to Brazilian audiences can continue lawfully. Advertising and intermediation fall within the measure's scope. Operators, publishers, networks, creative agencies and traffic buyers should review live placements, landing pages, links, targeting, contractual obligations and payment arrangements. None of this establishes that every existing CPA or RevShare commission has automatically been cancelled.

A REGULATORY SHOCK IS ALSO A CONTRACT SHOCK.

Stopping acquisition can interrupt new FTD volume. It may also complicate attribution windows, settlement schedules and the commercial expectations behind hybrid CPA + RevShare agreements. These are potential business consequences, not figures or outcomes established by the legislation. Partners should document campaign stop dates and reconcile outstanding balances directly under their agreements and applicable law.

PROVISIONAL MEASURE DOES NOT MEAN PERMANENT STATUTE.

A Brazilian medida provisória has force of law while effective, but proceeds through a legislative process. The Chamber of Deputies records MPV 1394/2026 as a measure presented on 25 September and subject to parliamentary consideration. Its status can change, so legal teams should verify the current official record before making forward-looking decisions. An eventual legislative outcome must not be assumed in advance.

BETDILLA'S TAKE: GEO DIVERSIFICATION IS A RISK CONTROL.

Brazil is not a normal fixed-odds betting acquisition market under the currently reported prohibition. The practical priority is an exposure audit: which offers target Brazil, which creatives remain live, which landing pages still route users to betting products, and which partner settlements need review? A portfolio spread across GEOs is not only a growth strategy. It can also protect an affiliate business when the legal basis for an entire vertical changes.
